Ban?

hi,myfriend went to india for her annual vacation. but due to family circumstances, she wont be able to come back and join her work. she is very scared that our companywill ban her.. is it possible? or if the reason is valid, will she be spared from the ban?

depends on what kind of company she works for. There are two kinds of companies here. The Understanding and the Stupid. Stupid is more widespread, but if she's lucky and gives a formal resignation letter that states the reason and sends it to them via fax, I don't think they will ban her.

They'll only try and ban her if they feel she's asconded. If she explains the situation - and make sure the Ministry of Labour knows as well - then it shouldn't be a problem.

Depends on which kind of company, is exactly the point. This ban or not ban is actually abused by most companies here.

My friend quit a small-time company within a month of getting a 3-year residence visa, and even argued with the boss. Surprisingly, they didn't ban him, but made him work to cover visa costs (6K apparently). Bans by companies are purely out of spite.

ok..now she has applied for a 6 month break from work and its under consideration with the HR department... lets see what happens!!!

Just to play Devil's Advocate on this, the single most common excuse I hear from people not coming back on time is "family issues". It's amazing, people can live here for 3 years then the 2 weeks they go home the biggest possible family emergency you can think of comes up and they have to stay longer. And one that means you have to stay home for 6 months, well, whether true or not, that's a belter.

You'd be sacked in many countries for this sort of behaviour, not just Dubai. Employment bans shouldn't be enforced often, but they are needed as a tool as the extended leave issue is far too often abused.
